For the purposes of these Terms, the following definitions apply:

  • "Service" or "Services": Refers to senior living accommodations, community programs, tours, Extended Visit Programs, and related offerings provided by Goldenleaf.
  • "User," "You," or "Your": Refers to any individual accessing our website or using our services, including prospective residents, current residents, and their representatives.
  • "Website": Refers to the Goldenleaf website and any associated digital platforms.
  • "Resident": An individual who has entered into a residence agreement with Goldenleaf.
  • "Agreement": Refers to these Terms and any additional residence agreements or service contracts.

3. Eligibility and Capacity

To use our services or enter into agreements with Goldenleaf, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding contracts
  • Provide accurate and complete information when required
  • Comply with all applicable laws and regulations

For residence services, individuals must meet our community's eligibility criteria, which will be discussed during initial consultations and tours.

4. Description of Services

Goldenleaf provides senior living services in Bangkok, Thailand, including:

Community Tours

Complimentary guided tours of our facility, provided by appointment. Tours are informational and create no obligation for either party.

Extended Visit Program

Short-term residential experience (1-3 weeks) including accommodation, meals, housekeeping, and activity participation. Subject to availability and advance booking.

Full Residence Services

Long-term living arrangements including private accommodations, meals, housekeeping, activities, and community participation. Subject to separate residence agreement and monthly fees.

Important Clarification: Goldenleaf operates as a non-medical senior residence. We do not provide medical care, nursing services, or treatment for medical conditions. Residents requiring medical attention should maintain relationships with appropriate healthcare providers.

5. Website Use

When using our website, you agree to:

  • Provide accurate information in contact forms and inquiries
  • Use the website only for lawful purposes
  • Not attempt to gain unauthorized access to any part of the website
  • Not transmit viruses, malware, or harmful code
  • Not use automated systems to access the website without permission
  • Respect intellectual property rights in all website content

We reserve the right to suspend or terminate website access for violations of these terms.

6. Payment Terms

Pricing

Service fees are as follows:

  • Community Tour: Complimentary (฿0)
  • Extended Visit Program: ฿9,800 per week
  • Full Residence: ฿45,000 per month

Payment Schedule

Payments for services are due as follows:

  • Extended Visit Program: Payment in full prior to visit commencement
  • Full Residence: Monthly payment due by the 1st of each month
  • Late payments may incur administrative fees

Accepted Payment Methods

We accept payment via bank transfer, check, or other agreed-upon methods. Payment details will be provided upon service confirmation.

Refund Policy

Extended Visit Program: Cancellations with 7 days notice receive full refund. Cancellations within 7 days are non-refundable. Full Residence: Monthly fees are subject to the terms of individual residence agreements, typically requiring 30 days notice for changes.

7. Residence Agreements

Individuals choosing Full Residence services will enter into a separate, detailed residence agreement covering:

  • Specific accommodation details and apartment selection
  • Services included in monthly fees
  • Notice periods for changes or departure
  • Conduct expectations and community guidelines
  • Emergency procedures and contact protocols
  • Personal property and liability considerations

The residence agreement will be provided for review before finalizing any long-term arrangement. Both parties must sign the agreement for residence to commence.

8. User Responsibilities

Users of our services, including residents, agree to:

  • Conduct themselves respectfully toward staff and other residents
  • Follow community guidelines and house rules
  • Maintain personal property and living spaces appropriately
  • Respect the privacy and comfort of others
  • Report any safety concerns or incidents promptly
  • Keep emergency contact information current
  • Manage personal healthcare relationships and medical needs
  • Comply with payment obligations in a timely manner

9. Intellectual Property

All content on the Goldenleaf website, including text, graphics, logos, images, and software, is the property of Goldenleaf or its licensors and is protected by copyright and trademark laws.

You may view and print website content for personal, non-commercial use only. You may not:

  • Modify, reproduce, or distribute website content without permission
  • Use content for commercial purposes
  • Remove copyright or proprietary notices
  • Create derivative works from website content

The Goldenleaf name and logo are trademarks. Unauthorized use is prohibited.

10. Disclaimers

Our services are provided "as is" and "as available." While we strive to provide quality services, we make no guarantees regarding:

  • Specific health outcomes or improvements
  • Particular social experiences or relationships
  • Uninterrupted or error-free services
  • Results that meet individual expectations in all circumstances

No Medical Advice: Information provided by Goldenleaf staff does not constitute medical advice. Residents should consult qualified healthcare professionals for medical guidance.

Website Information: While we strive for accuracy, website information may contain errors or become outdated. We reserve the right to modify service descriptions and pricing.

11. Limitation of Liability

To the extent permitted by Thai law, Goldenleaf's liability is limited as follows:

  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount paid for services in the three months preceding any claim
  • We are not responsible for loss or damage to personal property except where caused by our negligence
  • We are not liable for medical conditions, health changes, or accidents unless directly caused by our negligence

This limitation does not affect liability that cannot be excluded under Thai law, including liability for death or personal injury caused by negligence.

12. Indemnification

You agree to indemnify and hold harmless Goldenleaf, its staff, and affiliates from any claims, damages, or expenses (including legal fees) arising from your violation of these Terms, your use of our services, or your conduct that causes harm to others.

13. Termination

Either party may terminate service arrangements under the following conditions:

Termination by User/Resident

  • Extended Visit: By providing notice and subject to refund policy
  • Full Residence: By providing written notice per residence agreement (typically 30 days)

Termination by Goldenleaf

We reserve the right to terminate services if:

  • Payment obligations are not met despite reasonable notice
  • User conduct creates safety concerns for staff or other residents
  • User's needs exceed our non-medical service capabilities
  • These Terms are materially violated

Effects of Termination

Upon termination, access to services ceases, and any outstanding payments become due. Personal belongings must be removed within agreed timeframes. Provisions regarding confidentiality, liability limitations, and dispute resolution survive termination.

14. Dispute Resolution

Informal Resolution

We encourage resolving disputes informally by contacting us directly. Most concerns can be addressed through open communication.

Governing Law

These Terms are governed by the laws of Thailand. Any legal proceedings shall be conducted in Thai courts with jurisdiction over Bangkok.

Mediation

For disputes not resolved informally, parties agree to attempt mediation before pursuing formal legal action. Mediation costs will be shared equally unless otherwise agreed.

15. General Provisions

Entire Agreement

These Terms, together with any residence agreements and our Privacy Policy, constitute the entire agreement between you and Goldenleaf regarding the use of our website and services.

Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force and effect.

Waiver

Our failure to enforce any provision does not waive our right to enforce it later. Any waiver must be in writing.

Assignment

You may not assign your rights or obligations under these Terms without our written consent. We may assign our rights to affiliates or in connection with business transfers.

Notice

Notices to Goldenleaf should be sent to [email protected] or our physical address. Notices to you may be sent via email, postal mail, or through website announcements.

16. Changes to Terms

We may update these Terms periodically. When we make changes, we will:

  • Update the "Last Updated" date
  • Post the revised Terms on our website
  • For material changes, provide reasonable notice to current residents

Continued use of our website or services after changes indicates acceptance of updated Terms. For existing residents, material changes to residence terms will be communicated directly and may require agreement to remain in effect.
